I. Application of These Terms and Conditions

With effect from October 27, 2020:

These “Terms and Conditions”, as operated by PAYNK Studio, shall govern your relationship with PAYNK Studio, including but not limited to, the use of the PAYNK Website  (www.paynk.space, the “Website”) and email (sharon@paynk.space, the “Email") to manage your account, bookings, communication, purchases and registration with PAYNK Studio, as well as the use of and attendance at PAYNK Studio (Address at 65 Ubi Road 1, #02-79, Singapore 408729, the "Studio").

By your attendance at PAYNK Studio and usage of the Website, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website, purchasing a PAYNK Studio class, booking a PAYNK Studio class, and/or attending a PAYNK Studio class.

PAYNK Studio has the rights to amend this information without notice. The Terms may be revised at any time by updating this posting. By using the Website or App, buying PAYNK Studio Class Packages, booking classes, your communication with PAYNK Studio, and your use of and attendance at PAYNK Studio, you agree to be bound by any such revisions.

II. Class Bookings

All bookings for PAYNK Studio classes have to be made via the Website at least 72 hours in advance. Bookings can also be made by emailing sharon@paynk.space, but booking is not guaranteed unless you receive a confirmation email.

Walk-ins will be entertained if the class is running and there is available space, at the discretion of PAYNK Studio. Walk-ins will not be entertained, refunded or compensated in any way if the session has been

III. Cancellation Policy for Booked Classes

You are able to cancel your class booking without any charges or loss of classes from your class or class package booking until 48 hours prior to class commencement time for all classes, via the Website's online booking system, email, or contacting Sharon via Whatsapp. Should you not cancel class before this time and do not show up for the class, a class will be deducted from your active Class Package or single class purchase.

IV. Late Coming and Early Departure

Unused class time for late coming and early departure will not be refunded or compensated in any way.

V. Classes and Class Packages

Purchases of classes or Class Packages can be made online on the Website. Alternatively, payments can be made via PayNow, PayLah, cash or bank transfer. We do not accept payments via Visa, MasterCard, or Nets. Alternative modes of payment can be arranged privately via Email or at the Studio.

You are allowed to gift your single class bookings. You cannot gift your Class Packages, and unused Class Packages cannot be refunded or redeemed for cash, before or after expiration.

Class Packages have an expiry date. Validity will be clearly stated on your Class Package purchase receipt sent via Email upon online booking. Expiry dates for Class Package varies and the expired Class Packages will not be refunded or compensated in any way. Unused, expired classes from the Class Package can rollover into the validity period of a newly purchased Class Package (not applicable for single class purchases). Rollover classes cannot be rolled over.

Extension of Class Packages validity period is allowed on a case-by-case basis, and you will need to inform the PAYNK Studio before the Class Package expires. Extension of up to one month is allowed for 4-class Class Packages, and up to two months for 8-class Class Packages. Seasonal workshops, one-off or promotional class or class package purchases cannot be extended.

Future class prices are subject to change. PAYNK Studio will honor your class or Class Package purchase price until the expiration date.

All Class Pack purchases are final and non-refundable.

VI. Coupons

Usage of coupons have to be made upon purchase, and PAYNK Studio do not allow retrospective usage of coupons. Coupons cannot be refunded, or cashed out.

VII. Lost or Damaged Personal Property

You are responsible for your personal properties. PAYNK Studio provides designated storage area for your personal belongings, and certain areas of PAYNK Studio is covered by CCTV monitoring system. Regardless of care taken to avoid loss, PAYNK Studio is not liable or responsible for any damage, theft, loss, or destruction of personal property within PAYNK Studio.

VIII. Intellectual Property Rights

The trademarks of PAYNK and PAYNK Studio are proprietary to PAYNK Studio and may not be used by you for any reasons other than as expressly permitted by these Terms. All Website content, design, text, graphics, and interfaces are property of, or duly licensed to, PAYNK Studio. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.

Any other use of materials on the Website and App, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of PAYNK Studio is strictly prohibited.

You acknowledge that PAYNK Studio and/or third-party content providers remain the owners of all Website materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any of such material in accordance with these Terms. PAYNK Studio may discontinue or remove the Website, or any portion thereof, or discontinue your right to use the Website, or any portion thereof, at any time.

IX. Use of the Site and Studios By Minors

All classes at PAYNK Studio are for ages above 16. If you are a minor under the age of 16, a parent or guardian must contact PAYNK Studio before making any purchase of class or Class Packages. PAYNK Studio reserves the rights to reject a minor's attendance of class and require a transfer of class or Class Package ownership. PAYNK Studio will not be held accountable for any misuse of the Website.

X. Warranty Disclaimer and Limitation of Liability

Under no circumstances will PAYNK Studio be liable for any direct, indirect, special, or consequential damages resulting from your use of the Website, any other linked/ third-party website, your purchase of PAYNK Studio classes, your booking of classes, your purchase of merchandise, your communication with PAYNK Studio, and your use of and attendance at PAYNK Studio, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if PAYNK Studio expressly advised of the possibility of such damage.

XI. Choice of Law

The Terms are governed by the laws of Singapore.
